OWNERSHIP AND RISK TRANSFER
The seller's rights to the land and to the existing structures immediately pass to the buyer, while the transfer of ownership of the structures to be built occurs as the building materials are processed.
The risk (the total or partial destruction of the item due to accident or force majeure such as storm damage, theft, fire, ...), on the other hand, is only transferred at the time of the provisional acceptance of the works (for apartments: at the time of the provisional acceptance of the private parts).
Furthermore, the agreement may not contain a repurchase clause².
Sanction: any conflicting clause is considered unwritten.
